Er, there is no cabal? :) I assume you mean that you're not stuck on the idea of requiring a unanimous vote.
While I think a board could readily achieve consensus on matters concerning assets like the trademark and domains, clearly there will be decisions that a board will not achieve consensus on. I think a supermajority of 5 strikes the right balance in keeping the foundation focused on its initial purpose while allowing for judicious expansion of that purpose if the broader community decides to go in that direction.
